PUBLIC AGREEMENT (PUBLIC OFFERING)

This offer is aimed at an unlimited number of people and is a public offer to enter into an Agreement Public Service Programme, published on the Internet at https://autoscambuster.com (in hereinafter, the Public Offer or Agreement) under the following conditions:

By making the Acceptance, the Client confirms:

• That all its actions are aimed at the actual occurrence of legal consequences stipulated by the Agreement.
• That the Client is not limited in the right to carry out transactions.
• That the Client is not recognized as legally incompetent (in whole or in part), does not remain in a painful state, is not suffering from illness at the time of the conclusion of this Agreement, is not under the influence of drugs and other medications that impede the understanding of the essence of the Agreement and/or its action or inaction.

TERMS USED IN THE AGREEMENT

• Acceptance: is the Client's full and unconditional acceptance of the offer by carrying out actions aimed at confirming the Public Offer using the capabilities Site Techniques.
• Client: is a person who has accepted the terms of this Agreement and becomes a the Client of the Contractor's services under the Agreement entered into. BASIC PROVISIONS

The agreement is concluded between the Contractor and the Client of the services in the form of an adhesion agreement.

This Agreement is a public agreement, which is deemed to have been concluded between the Contractor, on the one hand, and the Client, on the other hand, from the moment of Acceptance, the last of all, without exception, of the terms and provisions of this Agreement.

In the manner and under the conditions defined by this Agreement, the Contractor undertakes to provide the Services to the Client, and the Client agrees to accept and pay for the Services provided, in the event that that the Services are provided on a paid basis.

Actions that indicate consent to abide by the terms of this Agreement are acceptance by the Customer of the terms of this Agreement.

The Client carries out the Acceptance of the Agreement after reviewing its terms and conditions published on the Site by performing any of the following actions:

PURPOSE OF THE AGREEMENT

The Contractor provides the Client with informational, historical and statistical data on the sale of cars and other vehicles on major auction portals.

The user of the site has the opportunity to search for data about a specific batch or VIN number, as well as search for selected vehicle parameters (type, model, manufacturer, year of release, auction, auction date, auction location).

The Services, under the terms of this Agreement, are the provision of information services, namely, the provision of access to the Site and use of its functionality to Non-Commercial Personal Use And they can't be construed as the provision of advice and the sole source of information when purchasing a vehicle (the Service).

The information on the Site is provided "As is". The Contractor does not warrant that the Services meet the objectives and expectations of Users or any other person.

The information published on the Site consists of information published on auction portals and other open resources and may include technical, typographical, or photographic errors. The Contractor does not guarantee that no posting is accurate, complete, or current.

The Contractor may update the materials on the Site at any time without notice and is not responsible for updating resources.

COST OF SERVICES AND FEES

• The cost of the Services depends on the volume and nature of the Services provided, and is indicates immediately after the choice of a particular Service.
• The Contractor has the right to unilaterally change the cost of the Services up to that they are paid.
• The payment of the Services by the Client confirms familiarization with and full acceptance of the terms of this Agreement.
• Payment for the Services is made by bank transfer to the Contractor's account, whose details are provided to you after you choose the Service.
• The service is considered paid from the moment the funds are credited to the current account of the Contractor.

PROCEDURE FOR THE PROVISION OF SERVICES

Registration and Personal Account

1. For efficient and complete use of the Site, the User must register by completing correctly and By entering the following data: name, surname, email and telephone number of the User.

• Sales history of the vehicle.
• Access to high-quality photographs of the auctions.

The customer can receive a Report with information about the Lot on a paid basis. Reports provide information on vehicles from open Internet resources, auction portals and may contain photos as well as detailed information about vehicles that were available for the hearing in auction portals, if the vehicle was put up for auction.

The Report, in particular, but not exclusively, includes information on the characteristics of the vehicle, information on known damages, the history of the vehicle's sale at auctions, photographs, etc.

• The customer can pay for both the Report for a Batch and for a certain selected number of Reports.
• By paying for the Report, the Customer receives information about the Lot, which was in AutoScamBuster with this VIN number at the time of purchase of the Report. Yes after purchasing the Report, new or additional information about the Lot appears, the information does not it will be part of the purchased Report and requires additional payment.
• The Contractor does not guarantee that the Reports will be available for any vehicle, and also that the information in the Report is accurate, complete, verified, and complete.
• The Contractor Not responsible of the accuracy or completeness of the information provided in the Report. The Contractor does not provide a guarantee that the vehicle was not put up for auction at a auto auction if the corresponding entry is not in the Report.

RIGHTS AND OBLIGATIONS OF THE PARTIES

Rights and obligations of the Client

• Customer is entitled to receive the Services under the terms of this Agreement.
• The Client has the right to receive information from the Contractor about the Services being provided and the conditions for its provision.
• The Client has the right to log in to the Personal Account under his/her account at the same time from Just a Access Point (personal computer, laptop, netbook, tablet, etc.).
• The Client is obliged to provide the Contractor with information complete and reliable about your data. • The Client is obliged to ensure security and confidentiality of the specified information and used in the Personal Account. • The Client agrees not post or upload content or items to inappropriate categories and services on the Site.

• The Client agrees and confirms that by using the Services, in no event willdoes not contribute to fraud, deception or breach of trust;does not transact with stolen items, or counterfeit; does not affect the property of the Contractor or third parties, including property intellectual; does not publish information that offends the honor, dignity, or business reputation of Someone; does not carry out slander, does not threaten; does not ask for the commission of a crime, and neither incites ethnic and ethnic hatred; does not encourage terrorist and extremist activities.
• The Client has the right to require the Contractor to provide the Services in accordance with the terms of this Agreement.
• The customer has other rights provided for by Ukrainian law and international law.

Rights and obligations of the Contractor:

• The Contractor is obliged to organize and provide the Client with the appropriate provision of the Services in accordance with this Agreement.
• The Contractor is obliged to ensure the storage and processing of the personal data of the Client, to provide the confidentiality of this data in the process of processing it and to use it exclusively for the provision of high-quality Services.
• The Contractor is obliged to provide the Client with information about the provision of the Services at your request.
• The Contractor has the right to receive from the Client the information necessary to comply with its requirements. obligations under the Agreement.

• The Contractor has the right to shut down or suspend the operation of the Site or any part thereof, supplement, modify, update materials without prior notice to the Client.
• The Contractor has the right to unilaterally determine the cost of providing the Services.
• The Contractor has the right to conduct surveys, survey the Client, including the request for comments on the Services received, publish or otherwise distribute the results of the survey (survey), reviews about the Services provided.
• The Contractor has the right to unilaterally modify the terms of the Agreement by means of the publication of a new version of the Agreement on the Site.
• If the Client has contacted the Contractor with an official letter to the address info@autoscambuster.com, about the removal or change of information in a particular Lot, as such, that contains false, inaccurate or incomplete data, the Contractor must consider it and take all necessary measures.

LIABILITY OF THE PARTIES AND DISPUTE RESOLUTION PROCEDURE

In the event of a breach or improper performance of their obligations under this Agreement, the Parties shall be liable in accordance with the applicable laws of Ukraine, the terms of this Agreement, as well as and applicable international law.

• The Contractor Not responsible of the inability to use the Services for reasons Client's dependents.
• The parties, taking into account the nature of the Services provided, undertake, in the event of disputes and disagreements relating to the provision of the Services, to apply without fail the pre-trial procedure for the resolution of the dispute, in particular by sending the corresponding written complaint. If it is impossible to resolve the dispute in the order prior to the such disputes are resolved in court in accordance with the rules of jurisdiction and competence established by Ukrainian law and international law.

• The Contractor Not responsible of the Client's non-receipt of the Services under this Agreement if Customer is unable to receive the Services for technical reasons beyond the control of the Contractor, in particular, if the Client does not have access to the Internet as a result of the actions of communication operators, providers, influence of computer viruses and/or other programs malicious, due to lack of necessary software and hardware and/or improper payment for such access.
• The Contractor Not responsible of the Client's actions or omissions, as a result of which damage was caused to other Customers of the Contractor's services, and it is also not responsible for the damage caused to the Customer as a result of the actions or inaction of other Customers of the Services.
• The Contractor is not responsible for the non-conformity of the Lot with the Customer's expectations y / or their subjective evaluation. Such a discrepancy with expectations and/or a negative subjective evaluation is not a reason to consider that the Services provided are deficient or not to the extent agreed.

• The Contractor Not responsible of non-profit (revenue), earnings below the Client's expectations, as well as the Client's direct and indirect losses.

The Client is solely responsible for any consequences of its actions or omissions, including the expected results of the Service received.

PERSONAL DATA

By entering into this Agreement, the Client confirms that he is fully familiar with and agrees with his terms as well as the provisions of the Law of Ukraine "On the Protection of Personal Data", the Privacy Policy posted on this Site, and also gives the Contractor permission to process your data personal.

The personal data provided by the Client is personal and confidential information, according to the Privacy Policy published on the website Policy Privacy and that it is an integral part of the Agreement.

FORCE MAJEURE

The Parties are exempt from liability for partial or total breach of the obligations in under this Agreement if this breach was the result of force majeure circumstances (force majeure circumstances) that arose after the conclusion of this Agreement and made it impossible performance of obligations in accordance with the terms of this Agreement.

Such circumstances include, in particular, but not limited to:

• A prolonged lack of electricity and internet for reasons beyond the parties' control.

• War, military operations, uncontrolled and illegal acts and acts of vandalism by third parties, revolutionary actions, public disturbances.
• Acts or actions of government agencies, adoption of legal or regulatory acts that affect directly the ability of the parties to perform the terms of this Agreement.
• Any other extraordinary circumstances.

If the force majeure circumstances and their consequences continue to operate for more than three months, the Parties should negotiate as soon as possible to identify alternative methods acceptable to both Parties to comply with the terms of this Agreement and to enter into appropriate written agreements.

DURATION OF THE AGREEMENT AND THE TERMS OF ITS TERMINATION

This Agreement shall be effective upon Customer's acceptance of this Agreement and is valid until the Parties fully comply with their obligations.

This Agreement may be terminated early:

• By mutual agreement of the Parties.
• On the Client's initiative, in the event of a violation by the Contractor of the terms of the Contractor Agreement.
• At the request of the Contractor, in the event of a violation by the Client of the terms of this Agreement.

FINAL PROVISIONS

• Acceptance by Customer of the terms of this Agreement (acceptance of offer) is possible only in its entirety. The partial acceptance of the offer, as well as the acceptance of the offer in Other conditions are not allowed.
• The Client guarantees that all the conditions of the Agreement are clear to him and accepts them unconditionally and in its entirety, without any reservation or condition.
• The Client consents to be informed about the Contractor's other Services and (or) its partners by email to the address indicated by the Client. This consent is granted by for an indefinite period and is valid until the Contractor receives notification from the Client of the refusal to send it to the email address info@autoscambuster.com.
• Cases not regulated by this Agreement, the Parties undertake to resolve them, guided by the standards established by the current legislation of Ukraine and international standards.
• The Parties mutually consent to the processing and storage of data personal information that they know in connection with the conclusion of this Agreement, to the extent necessary in accordance with the requirements of applicable law.
